Sometimes I get questions like this (I got one just yesterday): "Why doesn't the seller fix this problem when they already know about it?". It's a question I can quickly understand from the point of view of a buyer, especially an inexperienced one. Why would the seller want to keep the fault in the car they're trying to sell? Here's the answer.
If you don't declare the fault (and the car has a fault), and the buyer finds it after the sale, then the seller is legally responsible and you'll likely have to pay for the repair. However, if you clearly describe what's wrong with the car, before the buyer has even committed to the purchase, then the buyer receives the car 'as described'. This means that they can't later come back to you and say that the car has a fault.
So it's better to tell the buyer about the fault, rather than fixing it. This way, the sale is 'final'. The buyer buys the car 'as is' and the seller walks away with their money and no further worries. This is the seller's choice.
Now, it's also true that if you fix the fault, you could probably sell the car for more money. But a seller might not want to do that. They might not be able to afford the repairs, or they might not have the time. Or maybe they just don't want the hassle. It's often easier to sell the car 'as is' and let the buyer deal with the repairs. This is why you see so many cars for sale with faults. It's not because the seller is trying to rip you off, it's because they're trying to protect themselves.
So, if you're looking at a car with a fault, you should know that the seller is probably trying to protect themselves from any future claims. They're not trying to hide anything, they're just being transparent. And that's a good thing, because it means you know exactly what you're getting into.
