These Terms & Conditions apply to purchases made through The Ashwell at theashwell.com.
By placing an order through our website, you agree to these Terms & Conditions.

- Customer / consumer / you: Any person purchasing products through our website.
- Agreement: The purchase agreement concluded between The Ashwell and the customer.
- Product: Any item offered for sale through our online store.
- Withdrawal period: The period during which an eligible consumer may exercise their right to withdraw from a distance purchase.

Article 3 – Applicability
These Terms & Conditions apply to all offers, orders and agreements made through The Ashwell. Before completing an order, customers have the opportunity to review these Terms & Conditions through our website. Any mandatory consumer rights provided by applicable law remain unaffected by these Terms & Conditions.
Article 4 – Products and Offers
We aim to describe and display our products as accurately as reasonably possible. Product images, descriptions, sizes, colours, specifications and other information are provided to help customers make an informed purchasing decision. Minor differences in colour may occur due to screen settings, lighting or photography. Prices and promotional offers may be changed from time to time; changes will not affect orders already confirmed. We reserve the right to correct genuine pricing, description or technical errors.
Article 5 – Prices and Payment
All prices shown on the website are displayed in the applicable store currency. Before an order is completed, customers will be shown the total purchase price and any applicable shipping charges. Payment must be made using one of the payment methods available during checkout. Payments are processed through secure third-party payment providers. We do not directly store customers' complete payment card details.
Article 6 – Formation of the Agreement
A purchase agreement is formed when: (1) the customer places an order through our website; (2) payment has been successfully submitted or authorised; and (3) the customer receives an order confirmation from us. We reserve the right to cancel and refund an order if we are unable to fulfil it due to stock errors, technical problems, suspected fraud or other legitimate reasons.
Article 7 – Order Processing and Delivery
Orders are prepared and processed after successful order confirmation. Estimated processing and delivery times are provided on our Shipping Policy page and, where applicable, during checkout. Delivery times are estimates and may occasionally be affected by circumstances outside our reasonable control, including carrier delays, customs processing, severe weather, public holidays, local delivery disruptions, or incorrect/incomplete delivery information supplied by the customer. Article 8 – Shipping and Customs
We ship products to the destinations made available through our website. Shipping availability, estimated delivery times and applicable shipping charges are explained in our Shipping Policy and during checkout where applicable. For international orders, customs duties, import VAT or other import-related charges may be imposed by the destination country. Where such charges are not included in the amount paid at checkout, they may be collected separately by the relevant customs authority, postal operator or delivery carrier. These charges are determined by the destination country's authorities and are outside our direct control. Nothing in this section limits any statutory consumer rights.
Article 9 – Right of Withdrawal and Returns
Eligible consumers may request a return within 14 days after receiving their order, subject to our Refund & Return Policy. This 14-day return period does not reduce any statutory withdrawal or consumer rights that may apply under applicable law. To request a return, customers must contact us at info@theashwell.com or follow the instructions in our Refund & Return Policy. Unless otherwise required by law or stated in our policy, the customer is responsible for return shipping costs when returning an item because of a change of mind. Different rules apply where a product is defective, damaged, incorrect or otherwise not in conformity with the agreement.
Article 10 – Condition of Returned Products
Customers may reasonably inspect a product to determine its nature, characteristics and suitability. Returned products should, where reasonably possible, be returned complete with all included parts and accessories, without unnecessary use or damage beyond what's reasonably required to inspect the product, and with original packaging where available. A missing or damaged original package does not automatically remove statutory consumer rights. Where a customer has handled a product beyond what is reasonably necessary, any reduction in value may be taken into account where permitted by law.
Article 11 – Refunds
When a valid withdrawal or return is accepted, refunds will be processed in accordance with our Refund & Return Policy and applicable consumer law. We may wait to issue a refund until the returned goods have been received, or the customer provides evidence the goods were sent back, whichever occurs first, where permitted by law. Approved refunds will normally be made using the original payment method. Processing times after a refund is issued may vary depending on the customer's bank. Where required by applicable withdrawal laws, standard outbound delivery costs will also be refunded; additional costs from a more expensive delivery method chosen by the customer may not be refundable where permitted by law.
Article 12 – Defective, Damaged or Incorrect Products
If an item arrives damaged, defective, materially different from its description, or different from the item ordered, please contact us as soon as reasonably possible at info@theashwell.com. We may request photographs or other reasonable information to investigate. Depending on the circumstances and applicable law, an appropriate solution may include repair, replacement, refund or another suitable remedy. Nothing in this section limits statutory rights relating to defective or non-conforming goods.
Article 13 – Cancellations
Because orders may enter processing shortly after being placed, cancellation requests should be submitted as soon as possible. If an order has not yet entered processing or shipment, we will make reasonable efforts to cancel it. If cancellation is no longer possible, the customer may use the applicable return procedure after receiving the order. Any statutory cancellation or withdrawal rights remain unaffected.
Article 14 – Customer Responsibilities
Customers are responsible for providing accurate and complete information when placing an order, including full name, delivery address, billing information where required, email address, and telephone number where required for delivery. Customers should contact us as soon as possible if they discover an error. We cannot guarantee that delivery information can be changed once an order has entered processing or shipment.

If you have a complaint regarding an order, product or our service, please contact us at info@theashwell.com with sufficient information for us to identify your order and understand the issue. We aim to acknowledge and respond to complaints within a reasonable period.
Article 16 – Intellectual Property
Unless otherwise stated, content available on The Ashwell website, including website design, written content, graphics and branding, may be protected by intellectual property rights. Website content may not be reproduced or commercially used without permission where legally required. Nothing in this provision claims ownership over third-party intellectual property belonging to its respective owners.
Article 17 – Website Availability
We aim to keep our website accurate, secure and available. Temporary interruptions may occur due to maintenance, technical issues, updates or circumstances beyond our reasonable control. We may modify or update the website and its functionality where reasonably necessary.
Article 18 – Liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be prohibited by applicable law. To the extent permitted by law, we are not responsible for losses resulting solely from circumstances outside our reasonable control. We remain responsible for fulfilling our obligations under the purchase agreement and applicable consumer protection laws.

Personal information is processed in accordance with our Privacy Policy, which explains how personal information may be collected, used, stored and shared in connection with the operation of our online store.
Article 20 – Changes to These Terms
We may update these Terms & Conditions from time to time to reflect changes in our services, business practices or applicable legal requirements. The version applicable to an order is generally the version available at the time the order is placed. The latest revision date is displayed at the top of this page.
Article 21 – Governing Law
These Terms & Conditions are governed by the laws of the State of Wyoming, United States. Consumers residing outside the United States retain the benefit of mandatory consumer protection provisions that apply to them under applicable law in their country of residence. We will first attempt to resolve disputes amicably. Where a dispute cannot be resolved informally, it may be submitted to a competent court in accordance with applicable law.
